Sebalu & Lule boasts of extensive experience in civil and commercial litigation and commercial arbitration. The firm has been involved in several landmark cases in the fields of banking, contract, real estate and constitutional law and in specialized spheres of law such as expropriated properties, utilities law, employee benefits and aviation. The firm’s Partners had the great benefit of conducting their tutelage in litigation under the guidance of Mr. Godfrey.S. Lule SC, founding and now retired Partner of Sebalu & Lule. Mr. Lule is a former Attorney General of the Republic of Uganda and a Senior Counsel (the equivalent to the UK Queen’s Counsel).

Some of our notable achievements in litigation and arbitration include:

  • Successfully defended a leading financial institution against a US$ 8.8 million claim instituted by Alcon International in the East African Court of Justice.

  • Successfully prosecuted a UGX 1.1 billion claim in the Supreme Court involving the entitlement to terminal benefits following the expropriation of property.

  • Successfully prosecuted a case in the Supreme Court that raised novel points of law regarding the effect of third party transactions on the relationship between a mortgagor and mortgagee.

  • Successfully defended a leading petroleum company before the Court of Appeal in a US$ 300,000 claim arising out of a fuel cargo transport agreement.

  • Successfully defended the aviation industry regulator in a landmark aviation negligence claim before the Court of Appeal.

  • Successful counsel for a leading South African company in US$ 1.2 million arbitration proceedings against the Uganda Investment Authority (UIA).

  • Successful counsel for a local company in a dispute against the Government of Uganda and obtained an arbitral award of UGX 8.4 billion. Also consequently successfully defended opposition proceedings to the arbitral award lodged in the High Court.

  • Successfully defended a leading financial institution in a US$ 1 million claim upon a documentary credit.

  • Successfully prosecuted, on behalf of a leading petroleum company, a UGX 200 million claim against a fuel agent with respect to a claim upon a performance bond.

  • Successfully defended an insurance company in a US$ 2 million marine insurance claim.

  • Currently defending a UGX 950 million negligence claim against a leading tobacco manufacturer and distributor in the High Court.
